New State Law Means 10-Day Housing Approvals
On 12 December 2008 the NSW Government announced:
" a new code that allows home builders to get approval for new houses and extensions within 10 days, saving 110 days and $6,500 per application". Planning Minister, Kristina Keneally, said the new code will help create a faster approval system for new detached houses, house extensions and minor development.
This is important as it enables home owners to gain timely approvals for their renovations or new homes without going through what can be a very stressful development application process.
Within the NSW Governments announcement on 12 December 2008 they also stated:
"Last year it took an average of 123 days to approve development applications for new detached houses in Sydney".
The new code, titled "State Environmental Planning Policy (Exempt and Complying Development Codes) 2008" commenced on 27 February 2009. It is also known as the "Housing Code".
This new code now allows Private Certifiers to issue approvals for particular types of detached housing building work in a similar manner to the way Council's approve development applications. These types of approvals include:
As you would expect there are certain criteria that must be met to enable the Private Certifier to issue an approval. For instance, Complying Development must not take place on lots smaller than 450m2; nor on land that is listed as a heritage item, draft heritage item, a heritage conservation area, or a draft heritage conservation area.
The Housing Code is not applicable to commercial or industrial buildings.
